Regarding The Power of the Pen - Just To Be Absolutely Clear…

We have no wishes for any contractor anywhere to not be able to operate legally and earn an honest productive living.

On the contrary, we hope there are more reputable contractors are in the proverbial pool available to the public.

It can only serve to create competitive pricing and better workmanship. That translates to more satisfied customers and likely repeat business for those reputable contractors. Win-Win don’t you think?

If the knowledge of what to check for before contracting with a business saves some people the aggravation and costs of dealing with a less than reputable or professional contractor, how can that be construed as a negative? Unless you are one of those unscrupulous contractors maybe?

The onus of ethical behavior is upon the business and/or contractor, and if that responsibility is not met, it is not the customers fault. And it should come as no surprise that the word of bad service travels farther and faster than that of good service.

Contractors: Don’t get mad at the consumer if you fail to follow the rules and laws in place, or get caught lying to or cheating a customer. You need to take responsibility.
Expect the customer to tell others what transpired. If you are lucky it will be recognition for a job well done. If you are less than ethical, you deserve what you get when they share the truth publicly.


We are only offering this information to help enlighten the public to protect themselves from the contractors that are out there not being honest, ethical or operating above the laws of the applicable areas they may work in.

Remember, this blog was only started after and because we were taken advantage of by an unscrupulous, dishonest and unethical contractor and the refusal by the parent company to take responsibility when our home was seriously damaged by Re-Bath. If they had acted ethically and made proper restitution, we would not have felt the need to share our experience.

Hmmm Something Seems Somewhat Familiar About This “Anonymous” Comment...

As you can see in the comments section of responses to our blog post titled Very Bizarre, “Anonymous” wrote:
"I would have to say your hate blog is homophobic, gay bashing and anti-female, Mr. Helpful Hal. Why do they allow you to post such thing?"


So... We’d like to respond to that “Anonymous”:

Hate blog? Since when is trying to protect the public by sharing a truthful story of a home repair nightmare a hateful action?
Anyone else find anything we wrote to be "homophobic", "gay bashing" or "anti-female"? Didn't think so!

We had to wonder how long it would take for a weasel to drag itself out of the gutter sludge and how ignorant they must be to come to that “conclusion” considering the facts that were posted in this blog.

We made no comments that could be construed as homophobic or anti-female by anyone who can read at or above a second grade level.
However, yes, we do hate what Re-Bath and Mr. Summy have done to us and our home, but that does not make this a “hate blog”.

Clearly the troll who wrote this referenced comment has either an inability to understand simple English, or just wants to be a jerk, (maybe they can’t help it? We have met such an individual...). In addition, what possible benefit to this discussion did they think could be made by posting such a red herring of a comment? Or is that the best they could do to tes the waters and see if we were still monitoring the comments to our blog? What a moron for insinuating we wrote such tripe. (That's not gay-bashing or anti-female, it's social commentary.)
Yes we monitor the blog, but until this didn't see too much that warranted us to add to it.

And to answer your lame question, "They” allow us to post these truths and opinions due to the First Amendment. Same reason as you are allowed to post the misleading comment you did. Try to enlighten yourself before exposing your lack of cerebral acuity next time.

By the way, (Mr and/or Ms "Anonymous") your comment reads as if it was written by fatbutterfly2 herself or someone else mentioned in this post… And in addition, it follows a pattern we have been tracking from earlier posts made to this blog. Hmmmmm.....interesting...
Please continue to post in the same fashion, or try to figure out what the pattern is so you can alter your style, either way, we have this tagged. Or go the hell away you LOSER!

It is very sad when a disreputable contractor who got busted for illegal practices harasses the customers he cheated for years afterward.
Just serves as a reminder to do your homework before contracting with any home improvement company or person, lest you get the same treatment we have been subjected to.
We found out too late the Re-Bath franchise we contracted with was operated by a dishonest and vindictive jerk. Apparently it is the way other Re-Bath franchises operate as well from what other people have posted within this very blog as well as all over the internet...


Research thoroughly before contracting with anyone, check for valid licenses and that all workers are legal to work. Please protect yourselves!

Very Bizarre...

This comment was posted to our blog on 9-6-10:

"I want to know who Fatbutterfly2 is. I saw that posting about you trying to pick up on and harass the salesman and wondered why it was posted by someone other than Helpfulhal."

It brings up something we wondered how much had been seen and originally decided to ignore publicly. But things have changed now that it has been brought up and since we found out who we believe the author is. Rather than responding to it in the underlying comments section, we thought combined with what we learned semi-recently, and the fact someone asked about it openly, warranted clearing our name on the front pages of the blog.


To be clear, it was NOT HelfulHal that posted those fatbutterfly2 blog posts.

That was a “clone” site that “Fatbutterfly2” created and posted to make it look like HelpfulHal was a disgusting homosexual hawking pervert. Not even the same web address as our blog by the way. Whoever did it created one page, then copied and (poorly) edited/corrupted a page from our blog, and inserted some nasty allegations. A very sick mindset to be sure by someone who knew way more details than we ever allowed to be shared in out blog. (Those sensitive items will not be shared by us even at this time.)

Information only known to Re-Bath employees. And we really doubt the corporate side would delve to these depths. Considering some of the other comments we received, it does not take a rocket scientist to figure this out. (And how do you know that HelpfulHal is or is not a rocket scientist...?)

Bizarre posts with intent to paint us in a negative light that immediately lead us to believe that the same manager/owner of Long Beach/Signal Hill Re-Bath was responsible. While it has subsequently been taken down, we did make a copy of it before it was removed. We are concerned this has come up as we thought it was gone, but feel it is our right to try to clear our "name".

But interestingly enough, as much as we had our opinion it was done by this pain in our ass, (since he posted a comment to our blog directing us to view it). Imagine how astounded we were to see what appeared to be the answer to who did this when we were in court (again) because of this ongoing nightmare, and saw him and his female companion. (Ironically we assumed he was gay from the first time we met him, but it is irrelevant, at least we thought it was at the time.)

We noticed on the left inside calf of Mr. Summy’s companion’s leg a tattoo of a rather chubby (fat) butterfly!
If it was not her, (and we are confident it was one or both of the two), who posted those disgusting perverted posts, why did she become so upset when this observation was made to the Judge connecting the screenname fatbutterfly2 to Mr. Summy by way of his plump female companion and her tat-2?

Circumstantial? OK, so provide us with another more logical explanation.
Occam’s Razor you know.
The simplest explanation is usually the correct one…

Just to show how low Mr. Summy stooped to harass us, not content with just unfoundedly suing us (and not losing), here is a sample of what were are sure he posted.

Note the author “fatbutterfly2”.
Also keep in mind that the original installation date for the failed Re-Bath shower was October 5, 2007.

And this crap is posted 2 ½ years later?

Talk about vindictive contractors…

I am here to correct the record. One of Rebath salesmen gave us an estimate and when he left I found a condom on the counter of the bathroom. Everyone knows what that means even if nothing was said we had a connection. Now he will not return my calls and the installer is just a tease. He took off he shoes and later his shirt (a real Inca god) and then just left. Promises were made even if nothing was said.

Take A Bow? No, Take The Bow Out

Here's one more "live action" shot of how poorly yet another wall was installed.
See how bowed in at the light switch it was?
See the flex?
See how it is not properly adhered to the wall?
Notice the depth difference between the two switches?

Randy from Re-Bath of Ca originally told us he would replace this incorrectly installed wall when he came out on 10-12-07 and inspected the work done. (See our post in this blog from Friday, July 25, 2008)
Not all of them, not two of them (see video of mixer valve wall…), just this one.
But instead he sued us, even after agreeing it was not acceptable workmanship to our faces.

He didn’t even serve us the court summons legally. He just mailed it via regular mail and we received it shortly before the court date. (It should be served via Certified Mail. Or by a party not involved in the action.)
Then, in court and under oath, he originally claimed the Sheriff had served us, but we had already checked with and had verification from the Sheriff department that he never hired the Sheriff department to serve us. Of course he had no proof from the Sheriff, (as we do from our countersuit) to back up that false claim.

Then he claimed his father, Lloyd Summy served us in our front yard. Lloyd Summy was the name on the contractor’s license Randy Summy used, and apparently was the previous Re-Bath franchise owner (if not the actual or co-owner) so he was not qualified to serve us. (See our post in this blog from Thursday, July 31, 2008 )

So which story was the truth Mr. Re-Bath? The correct answer is neither.

Oh yeah, did we mention we never saw, let alone spoke to Lloyd Summy, not for lack of trying. (Actually, yes we did mention that…) And, he was NEVER at or on our property, (at least when we were there, but that is another story) so that would constitute a lie would it not? (In court under oath, is that perjury?)

This shows the level this Re-Bath “owner” was willing to go to instead of just doing the ethical thing he said he would do. (He gave us his “word”.) That would have been to repair the mess his company made.

Is that the kind of service you would want from a contractor? Do your homework, do your own research, before hiring Re-Bath or any contractor.

It is nice to have learned how to post pictures, perfect timing.

Here is some more of the sloppy caulking we were assured was an acceptable standard by Re-Bath of CA. The worst part is it is a silicone based caulk that rendered that door jamb unpaintable even after removing the caulk. Note both colors are pooly done, but wait, why is there white on the jamb in the first place?

Nice gouge, more evidence of the "care" that went into the installation, and yes, were were accused by Randy of claiming they did it "that it was there before". Trust us, they did make the gouge...
Here's another classic shot. They tore up the floor (note the same style of caulking at the base too, about as close to continuity we got) and then Randy claimed it was that way when they got there.

Well, it was that way when he got there, because his crack team did the damage, but this was the first time Randy had been to our home, how on earth could he know? But he argued in court under oath it was that way before the installers started...
Notice that they didn't even install a Re-Bath pan after all the bragging and selling us on how high the Re-Bath quality was? We're not sure if this is Bait & Switch, but the Re-Bath pan we ended up with is not as much of a flexi-flyer as this one was. Who are we kidding, not sure if it was Bait & Switch? Look at the label.

Since they say a picture is worth a thousand words…

We thought it was time to start sharing this irrefutable evidence of the “workmanship” Re-Bath did when they first tried to install our shower. Mind you, these are the exact same photos we showed in court and (deemed in the public domain as such), presented and accepted under oath as proof of the shoddy work done to our home by the Re-Bath franchise Mr. Summy “owns”. Please recall that he sued us (before finishing the job and without benefit of proper contractor licensing) and therefore saw these pictures then. Nothing was said at that time (under oath too) by him that these were not factual representations of the “quality” of work done by his franchise.

Are you following all that? These photos were shot the day following the installation (10-7-07). Please note that the "One Day, Stress Free, No Mess" installation started on 10-5-07 and was never truly finished by Re-Bath of CA. Anyone can do the math and see it was not done in one, let alone two days.

Let’s start with an example of the exquisite alignment skills of the installers. Notice the packing tape still hold this trim piece “straight”? Yes, the caulk is fully dry and that was deemed acceptable by them. Also note the slopped caulk at the top of the window frame. Except for the house's glass and metal frame window, this is 100% Re-Bath work.

How about we show some of their incredible caulk work? Unbelievable as it may seem, this is exactly the work that was done around the window (dried) and they claimed this was fully acceptable caulking. Can you believe it?





We have many more photos as we had to take a lot of them since we were sued by the owner of the Re-Bath because we had the audacity to ask that he make good on his word of finishing this job before paying the balance.
Remember their slogan about the customer doesn't pay until the job is done to their satisfaction. Hmm, just realized they might mean Re-Bath when they say "their". Not the customer. Plausible?
We needed to prove he had not even tried to finish before suing us. We would not have needed to document this had he not caused this situation…
And since we had to eat the cost of printing them for the court, it seems only fair we share them with the rest of the world.

And before you blast us for not just re-doing the crappy caulking, think about this, if you were being charged almost $6000.00 to do this job, wouldn’t you expect a lot better quality?

Don’t you just love the attitude and gall from Re-Bath representatives when the reality of their product and “service” is exposed?

This was posted as a response to this blog by who we are quite sure is the Re-Bath franchise “owner” that created the mess we have:

If you find a self cleaning bathtub or shower please let us know! Rebath should come by every now and again so they can clean the body oil and soap scum off you shower. Why dont you just get another fucking shower if you dont like this one you fucking cry baby!!!

How much does that make anyone want to have this company do anything for them?
Is this just another example of those great people skills Mr. (supposed) Manager/Owner of Re-Bath in Long Beach?
No wonder the business name was changed. Oh wait, still doing Re-Bath but also Designer Bath now? What is the problem with that ever so wonderful product "Re-Bath", that another franchise name is warranted?
Call it what you want, but the principle character is still there and this response shows the unethical nature of Re-Bath representatives, as we are convinced who this is from.

And you can see the level of “courtesy” this childish and vindictive individual displays years after we have tried to move on. We are still being taunted and harassed.

No better words than those from the person we are sure is the culprit to illustrate the problems you too will have if you hire the Re-Bath we did, and possibly any other Re-Bath franchise. We can only speak from our experience. But this is too much.

(Funny how the salesman showed pictures of the great work they had done, but would not provide any actual references, now we know why. Stock photos we'll bet. Probably are the same in all the catalogs. No real satisfied customers maybe?)

Don’t you just love the “cry baby” term? This likely from a kid playing "owner" who threw a tantrum and sued us because "his franchise" at "his control" refused to finish the job or honor the contract and failed to be properly licensed? Shameful.

Mildew and Mold. Yep, that’s what we call Re-Bath Quality!

We have both a fan and a window where the Re-Bath installation was done, and we use the approved and recommended by Re-Bath cleaners daily. We live in a non-humid area, and it is pretty much summer at this posting time of this.
Too bad we have a terrible mildew problem now in our Re-Bath Shower. We point this out after another pain in the backside cleaning of the fungus.

We were told we would never have to worry about mold and mildew in our Re-Bath shower, but we now know firsthand about the level of “integrity” and “honesty” of Re-Bath sales people and franchise operators.

We were told that the adhesive and caulking had compounds (fungicides) in them to eliminate the possibility of mold and mildew. We wonder why it began grow so soon after the installation? Actually we know why, cheap materials poorly installed by people who mislead us when they told us about what we were being sold…

Another word of warning to all potential Re-Bath (or whatever new franchise name your local post Re-Bath "scammer" is using) customers. You would be well advised to not trust them. If you have a mildew or mold problem now and want them to relieve you of that problem, they probably won’t be able to do it. Don’t believe their B.S. promises, do some homework. The system they sold us does not work in our home and they will not honor their “guarantee”. The only possible guarantee is that you too will likely be dissatisfied.

Back to scrubbing… Maybe we will start posting photos to show the crappy work and subsequent reality of one of the worst mistakes we ever made, contracting with our local Re-Bath.

Unbelieveable! We Are Still Being Harrased By The Jerk(s) From Re-Bath After All these Years!

This jerk who either is, or is pretending to be, Lloyd Summy that is posting comments to this blog is proving to be quite an entertaining yet obviously unstable, pathological liar, or worse, true psycho stalker type in our opinion.
He is apparently back to sending repeated comments under the name "Anonymous" after using "his name" of Lloyd Summy.

Why would the "father" of the cheating manager of a poorly run Re-Bath franchise expend so much effort to hound a past Ripped-Off customer? Are we the only ones being harrased by this guy?
It is beyond us.
Is it part of the Re-Bath "How to screw the customer handbook"? Assuming there is one, but the amount of the same stories on the web is enlightening...

Plus, we never dealt or even so much as spoke with this "Lloyd Summy". We did have to contend with his dishonest (possibly mentally or emotionally challenged) son Randy, and that was distasteful enough to say the least. Like walking through a turd farm and not being able to scrape the poop off later. (Seems like we missed a piece now...)

Interestingly, we had a sense of mental instablity with this guy when we first had the "pleasure" of meeting him.

But it does illustrate yet one more reason to steer clear of Re-Bath and the people that operate some of the franchises. We thought we were done with this nightmare, but this vindictive jerk is still hounding us HOW MANY YEARS LATER!? Good grief! What does that tell you?
We will not be posting all the tripe this jerk continues to vomit up at us, but we are saving it for our protection.

And since we know you are reading this "Lloyd Summy/Randy Summy" and "Anonymous". Back off and leave us alone. Go away!

It would appear our local Re-Bath has raped as many customers as they think they can in this area…

We went by the local Re-Bath “store” (the one we visited prior to purchasing our nightmare) the other day and it was gone. Gee, with such a quality product how could not stay in business? Yeah, right. Must've been their ethics, (lack thereof?).

A couple guesses: Either they gave up on our area, or enough people wised up to their scam that they could not afford to stay. Maybe they took from as many as that area could manage?

Not like it was in a high rent area, they were a scab on a blighted area. Good riddance whatever the reason is our take on it. We just hope they did not set up shop somewhere else to the detriment of another community.

Mold And Mildew

If you recall… part of the sales pitch it was that Re-Bath uses materials that have fungicide and mildew inhibitors. That the installation will not be susceptible to such growths...
Well, you guessed it, Re-Bath lied to us.
Our shower is so full of mold and mildew, even though we spray it down with the recommended (by Re-Bath no less) shower cleaner daily. And we do not live in a humid area. We have a fan and a window so it’s not like it should be a breeding ground for something “guaranteed” not to grow in this environment.

Just one more reason to NEVER DEAL WITH RE-BATH unless you enjoy having your time wasted, your intelligence insulted, and your home damaged all the while, paying through the nose for the privilege of having them screw you.

We just wanted to make sure everyone knows about this scam so we will continue to update this blog with the shortcomings of the abysmal installation attempts as they decompose. If only Re-Bath and it sleazy employees only had the life expectancy of this crappy product. Not to be confused with the B.S. line of lifetime warranty, we mean the real life of it, which makes a used Yugo look like it will last forever by comparison…

Just noticed one more thing Re-Bath ripped us off for…

We just realized they never installed the grab bar or shower rail, whatever it’s called, that they sold us. When they first did the installation they “forgot” to bring it even though we asked each day, and they “forgot” each day before claiming we did not order after repeatedly “forgetting” it.
Yes, it was supposed to be a One Day Installation, but you can read earlier blog posts to see how that works.
If we did not order it, why did they claim they “forgot” it so many times before claiming we didn’t order it? Yep, goes right back to that honesty issue we’ve discussed that Re-Bath has such a hard time with.

We sadly also just noticed what looks like rust around the door tracks. It surprised us since we have never had a rust problem, and thought the material was aluminum, which doesn’t rust, or stainless steel, which shouldn’t rust either. But it seems to be par for the course as every time we turn around we find more about how much worse the terrible installations really are.

Call and ask for them to honor their warranty you ask? Yeah, they will either blow us off like before, or they will make matters worse like they did before. We cannot trust anyone in or associated with Re-Bath due to the actions we were victimized by.

We shudder to think what we will find next. Maybe the economy taking a dive has one potential good thing tied to it; it may put Re-Bath out of business. Sorry to all the people who think they have Re-Bath warranties, but really, you don’t have jack. But at least if they go under, many people will be spared the nightmares we had to endure by foolishly believing the lies they fed us.

It’s been asked that we provide a little closure to our story. Sorry for the delay, life got in the way…

Here’s a partial re-cap of what we are left with besides a huge loss of money because of Re-Bath…

So, we have:
A Crappy Installation.
We still are trying to clean up the caulk and silicone slopped throughout. Plus the caulking around the joints is very unprofessionally applied.
It is depressing every time we look at the bathroom. We were ripped off and now have to live with the poor job they did. The only way to fix it properly is to gut the entire thing out and build new. Unfortunately that won’t be happening soon since these weasels ripped us off so well.

Mold.

We were guaranteed that the installation would not get any mold, EVER! But it started growing mold within less than two months, and that happened on every installment.
THEY LIED ABOUT IT BEING MOLD PROOF! But then finding something they didn’t lie about is gonna be tough…
As you may have read, Re-Bath lied about just about everything. Yes, that is a general statement, but we are pissed at them for what they did wrong and did not do right and how they treated us.

Sadly it is a well ventilated shower with both a window and a fan, and we don’t even live in a humid climate.
We have a dank back bathroom in the same house that has no mold whatsoever. Simple deduction says it has to be Re-Bath’s materials that are responsible for the only mold problems we have in our home.

A Cheap Shower Pan.

The shower pan itself feels springy and overly flexible. It creaks and cracks when we step in it. We are afraid it will crack through. Guaranteed for life they said… Well, let’s hope we don’t need to find out; we certainly don’t have any piece of mind due to the treatment, tactics and lies we’ve experienced from Re-Bath and its operatives.


Shower Doors That Are Hung Crooked, Just Like Re-Bath. (At least they are not upside down now.)
We tried to have them hung straight, but they siliconed the top bar crooked with so much adhesive it can’t be repositioned with damaging the walls.
They are off enough that they creep open when the shower is in use, maybe from the flexing of the pan? And the vertical edges are clearly not straight either.


Walls that Look Wavy and Untrue. (Amazing how so many adjectives describing the poor workmanship also describe the ethics and the way Re-Bath operates.)

Maybe it’s because we’ve had time to look at the installation for a while now, or maybe they are going weird with time too, but they are absolutely not true and it is very apparent. The seams look like crap. We’ve said it before, but it bears repeating, it looks like a seven year old with poor motor skills and bad eyesight did this installation.

Impossible to Touch Up Paint
They smeared unpaintable silicone and caulk everywhere. When we tried to repaint around the edges where they did such a crappy job of caulking (as well as tearing up the painted surfaces of the walls and ceiling), we found it was now unpaintable. We don’t know if they did that because they are ignorant unskilled workers, or if it was done intentionally to spite us. Or both. Due to the material they used we couldn’t even mask it off to spray to touch up.

Just as well, it didn’t work well anyways. Just like Re-Bath employees! The main shower head itself was replaced months ago (by us) as it didn’t even last long enough for them to finish the installation. (Yes, that too was supposed to have a lifetime warranty.)

A Floor We Had to Replace At Our Expense
At least it looks good since we did it ourselves. But it was not a cheap repair of the damage they caused and refused to take responsibility for. And our workmanship only serves to make the bad job they did look even worse. So much for their claims of a high quality looking upgrade.

You are probably thinking we may be a tad overly bitter about this situation. Well if you were in our position and treated as horribly as we have been, you probably would be as angry too. Plus we feel it is our civic duty to warn others potential customers (or as they’ll probably call you, suckers) of these predators.

If their actions toward us are any indication of how they operate normally, then this is a group of people that will go out of their way to screw you. Why? No idea here, after all they do such a great job of screwing customers out of their money from the beginning, it boggles the mind why they also turn it into a personal attack situation too.

Beware of Re-Bath. They have shown themselves to us to be to be nothing more than a bunch of liars and cheats preying on trusting people. They will probably screw you if you give them half a chance. And the product they claim is so great and installed in our home is really just cheesy cheap low quality crap.

Talk about dishonest and unethical practices, (Talk about Re-Bath…)

The following day, after not accepting our phone calls, we received this from Heidi:

Subject: Re-Bath

The agreement that was faxed into us was amended from the original version of what was sent to you. Due to the fact that our General Release was not returned to us by 5:00pm on June 18th, 2008 we are considering our offer null and void and no further offers will be made.

Cowards and cheats. They refuse to speak with us. Since it was obvious Heidi was not mature enough or even had the authority we were led to believe she had, we had to contact the president and vice president of Re-Bath. Turns out these guys are just as cowardly apparently as they refuse to speak with us too.

You’d think they would want to resolve this, especially since it is 100% their fault. What a group of disgusting scheming cheaters and liars.
But they have our money and we need it to repair the damage they have caused.

Our response to these underhanded jerks was still civil and polite and fully clarified what had truthfully transpired.

Dated 6-19-08:

“Mr. Sanders, Mr. Murdock,We are very disappointed in the way this situation is being handled. Mr. Murdock, you stated "We would like to resolve these issues quickly to avoid any further delay & make sure you are fully satisfied."
When are you going to fulfill that statement? We, in good faith, did what we were asked to do by Heidi, met the time constraint of faxing the signed document, (See Heidi's email below. Heidi made no mention of requirements other than "by end of business day", and no time even mentioned at that.), only to have her deny the agreement by claiming she not to receive it by 5:00PM June 18th, 2008. And then claiming it was denied because it was altered. Nothing in her instructions prohibited altering the document in any way.
In actuality, Re-Bath's offer sent on 6-17-08 was a modified version of an offer we sent on 6-13-08. If you can modify the document for a counter offer, why can't we? We are only trying to make a fair agreement with you.
The fact is the fax was sent and confirmed received at the fax number provided by Heidi before 8:39AM June 18th, 2008. That provided Re-Bath with an entire day to contact us if there were any issues. We complied fully to the requirements given to us, (read the email).
Denial on the grounds she stated is not acceptable or part of the agreement. Nothing states we could not make a counter offer, or that such an offer would result in voiding the agreement or absolving Re-Bath of their responsibility. And it does not absolve Re-Bath of compensating us for the damages they caused to our home.
The changes made to the document reflected the oral offer made to me by Mr. Murdock during our phone conversation on 6-10-08. The original oral agreement protected only Re-Bath Corporate, and Re-Bath San Diego, not Re-Bath of CA. The document was corrected only to clarify and reflect that agreement and still does protect Re-Bath corporate and Re-Bath S.D.
To deny it wholly on the grounds stated by Heidi is without merit and counter to our original discussions and intentions. It appears too many people are involved in this and are not sharing between them the information discussed with me.
Re-Bath had well over eight hours to respond yesterday if something needed to be addressed. An oral offer was made to us for $5050.00. We compromised and accepted it. A written offer that was not clear was sent, we returned it well with in the time frame with clarifications, no restrictions were placed on the document being returned adjusted for accuracy of the oral offer. We expect you to honor your word and warranty.”

But sadly, they are not an honorable company…

Oh Joy! We Get To Deal With A Subordinate Who Has No Real Authority And Only Wants to Cheat Us Out Of The Reimbursement They Owe Us

We’re sorry, is that too bitter sounding? (Yes, that is sarcasm again.) Well suffice to say that if it happened to you those would probably be the same emotions you’d have!

Soooo…, (yes, it is very exhausting to deal with these cheats), we sent an email (below) and we were in standard characteristically Re-Bath fashion ignored, so we re-sent it (on the same day) June 16th, 2008 with a little preface just to help Heidi along.
Courtesy is not a trait Re-Bath employee’s embrace.
Nothing like dealing with someone who has decided to go out of their way to cheat and screw you for being unlucky enough to have only done business with them in good faith...


“We have not received a response from you in the four hours since we originally sent this. Please contact us, at the very least, verify receipt. You say you want to resolve this quickly, yet you do not take any action in that direction.
Heidi, Norm said you are now handling the reimbursement of the damages. We would like to know when we can expect the money owed us by Re-Bath for the damage caused by the water leak Re-Bath of CA created. It is not fair to continue to cause us inconveniences.
Re-Bath said it would remedy the situation, but has not. To refresh you on the situation, $5050.00 covers the water damage. It is owed to us. Re-Bath, by law, must pay for the damages they caused. It is not negotiable. The lifetime warranty in writing is required, (from an email you sent us:

“Upon your agreement to the completion of the above work, San Diego Re-Bath will order the required materials and contact you to schedule the installation. Once the above installation is complete, you will receive the Re-Bath Limited Lifetime Warranty on the materials used. San Diego Re-Bath will offer their standard workmanship/labor warranty of one year.” ). A copy of the invoices from Pat's Pronto Plumbing for the work they did in our home is also required.If Re-Bath wishes to pay the partial out of pocket expenses we incurred because of Re-Bath CA for the total of $8130.00, we will release Re-Bath from the warranty responsibility. We still require a copy of the invoices from Pat's Pronto Plumbing.Re-Bath has already been sent release agreements for both options. We wish Re-Bath would uphold the commitment made by Norm Murdock in an earlier email:
"We would like to resolve these issues quickly to avoid any further delay & make sure you are fully satisfied."
That quote was sent to us almost one full month ago, yet still these issues have not been resolved. And we are certainly not satisfied because of that. We have provided everything we were asked to. Please find a way to resolve this now. You have my contact number; you obviously have my email address. Please contact me ASAP.”

"We would like to resolve these issues quickly to avoid any further delay & make sure you are fully satisfied." What a lie that line is! Yes, we’ve said it before, but they are the ones who lied by stating it.

For those keeping track of our time Re-Bath has wasted, this horror story has been running now for over 36 weeks. That would be 255 days. Closing in on 9 months.

For Heavens sake, it would have been easier to make a baby (certainly quicker) than it is to have Re-Bath do a One Day Installation. Good Grief! What a bunch of liars and cheats! Our recommendation: Do Not Deal With Re-Bath!

Coincidence? Highly Unlikely… And Frankly, The Comments Are Showing Quite a Bit of Ignorance.

Apparently this blog about the problems experienced while dealing with Re-Bath has struck a nerve…
We do see the humor and folly in this, but it is equally unsettling and disturbing.

All we wanted to do was point out how badly we were treated by Re-Bath and help inform other potential consumers so they could protect themselves from going through a hellish ordeal like we endured by being foolish enough to contract with Re-Bath.

But now the comments coming in response to our blog would suggest our most vocal readers have some “issues”. Anger? Oh yes, it sure seems like it. Mental instability? Again, it really seems like it.
Or could it simply be a case of the offender throwing another tantrum?

We’ve assumed, (and with good reason), some of the people we’ve dealt with through Re-Bath were, shall we say unbalanced, certainly predisposed to not have a firm grasp on the truth. But if these recent comment posts are indeed from Re-Bath affiliates, and therefore a possible indication of their state of mind, it is very alarming.
Remember, this is a company who initiated the problems and lied to us from the beginning, and got caught doing it; all we did was tried to defend ourselves from their dishonest practices and try to obtain fair compensation for the damage they ultimately caused.

This may only be a coincidence, but how utterly ironic can it be that only days after Randy Summy/Re-Bath of CA was notified by the California State Contractors License Board about the impending fine for illegal actions, this blog received a barrage of snide and juvenile “retorts”?
The timing is absolutely astounding!
Add to that, the majority of these comments arrived on the exact anniversary of the first bungled and botched attempt by Re-Bath of CA to install the low quality bathroom products they sold us.

We can assume it is Randy that is doing this. We can only guess the little jerk thinks it is safer to rage at us hiding behind a keyboard instead of prank phone calling this time around. There is a precedent that leads us to believe this is the situation. (See an earlier entry in this blog for an explanation if you wish. Blog post Friday September 6th 2008.)

And whether it is him, or possibly some other jerk(s), why only post by anonymous snipes? What is there to be afraid of? Too childish to stand up for the words you try to type? Feel like a big person firing off drivel while hiding like a little girl behind the shield of a computer? Think you really have any power when lying with the protection of assumed anonymity?

And no, we will not be publishing those unimaginative, curse filled comments that are basically what amount to no more than another childish temper tantrum, or on a more positive spin, a very pitiful effort at Lord knows what type of humor.

By the way, to the moron(s) who posted these comments, please, at least learn how to use spell check, we realize it is probably asking too much to request that you to actually learn how to spell, or even fathom what the words you are trying write truly mean.
Honestly, it made the writer (and we use that term loosely) sound like an absolute idiot, or maybe it is just that is what they are. Or maybe it’s time they put down the bottle before trying to communicate.
Thank us later for not allowing those posts to see the light of day. With as much refuse as is already floating around the internet, there was no need to pollute it anymore with garbage, and that is all it was, pollution.

While we welcome coherent comments and outside points of view in this blog, even ones that differ from our own, we also were intelligent enough to know there would be idiots such as the one(s) attempting to comment in these recent days. Of course we review all comments before allowing them to be posted. If someone wishes to post, we hope they can muster the mental ability to write something that is understandable and coherent, and not peppered with profanity. If that minimal goal is achieved, we will probably post it as we have in the past.

And a special sarcastic "thanks" to whomever posted (We can only assume it to be Randy Summy of Re-Bath CA, but yes, it is only an assumption) the offers to physically punish Re-Bath and its employees (Norm Murdock to be specific) in such a colorful way. We could also assume it is a misdirected show of allegiance to support our side of the described abominable situations created by Re-Bath, but we do not encourage nor participate in that type of behavior.
And it is actually rather disgusting what you advocate doing. You either need to take a step back and look at what you are doing in your life, or get some psychological help (and maybe sober up too) before you hurt yourself or anyone else.
(However, if in the case of the Darwinian theories holding true, you should only be on this earth but for a short time longer due to your own trials and tribulations, therefore absolving the rest of humanity from concerning themselves with you.)
But continuing to post such violent drivel will not do anything but show us the sad reality of your mental illness (or maybe simply your need to lash out from your perceived secure hole in the ground to fulfill something in your tiny unrewarding life) and require us to delete it.

Re-Baths Idea Of “Fair” Compensation… Not Fair to the Customer For Sure

Here is a copy of the very one sided release Re-Bath wanted us to sign to release them from all responsibility before they would pay for the damage they caused. Not all of the damage even, as mentioned earlier this was a compromise.

Imagine, demanding this forfeiture of rights to pay for damages they are 100% liable for.
Names and addresses are deleted for safety, but the rest is just how it was presented by Re-Bath.


GENERAL RELEASE

This General Release (“Release”) is made, this ____ day of June, 2008, NAME DELETED, an individual residing at ADDRESS DELETED (“Releasor”), in favor of ReBath, LLC, a Delaware limited liability company, and its franchisees, Re-Bath of CA and Re-Bath of San Diego.
In consideration for the sum of $5,050.00 paid by ReBath, LLC to Releasor, consisting of $4,800 for water damage repair, as per NAME DELETED Construction proposal #1875, and $250 for paint repair, as per Releasor’s 6/4/08 punch list, Releasor hereby releases and forever discharges ReBath, LLC, Re-Bath of CA and Re-Bath of San Diego, and their respective members, officers, directors, members, agents, employees, affiliates, attorneys, successors and assigns (collectively, “Releasees”) of and from any and all obligations and defaults, actions, causes of action, suits, proceedings, disputes, rights, claims and demands, at law or in equity (whether real or contingent, known or unknown) that Releasor ever had, now has or may hereafter against any of the Releasees, arising out of or in connection with the bath remodeling work performed in Releasor’s home at ADDRESS DELETED by a Re-Bath franchisee, and any explicit or implied warranty with respect to such work.

Talk about slanted and self serving!

Notice the wording “In favor of Re-Bath”. In favor of? They are paying out, in effect Losing. Yet they choose that phrasing? Got a bit of an excessive ego going on there maybe? A bit full of yourselves? Yeah, everyone knows what you are full of…

They word it in a way to try to void their own warranty and absolve them selves of any and all liability and responsibility.

Again, what good is a Re-Bath warranty? If you need to use it, they will try to void it just like this.

Of course they did not get that returned signed; instead pair of fairer options was presented to them, including an easy way off the hook for them.
But do you think they considered that?

Dealing with Re-Bath is like dealing with a spoiled child, a spoiled bratty bully who hides behind an ignorant mommy or daddy who thinks they can do no wrong when they don’t get their way.

Re-Bath Apparently Requires a Little Legal Refresher Course About Warranty Obligations

We had to send this on 6-13-2008 after reviewing the “release” Re-Bath corporate sent, seems someone was either going the extra mile to cheat us, or was very ignorant:

“Mr. Murdock,
The damage from the water leak caused by Re-Bath is not something that allows Re-Bath to eliminate the warranty we were given (see Heidi Seyler’s email below*) in order to be compensated. The warranty and the leak damage are two separate issues. The release you submitted is not a fair agreement. You are asking us to give up our rights in order for Re-Bath to pay for damages they directly caused and are already fully liable for.

Option one is payment in full, as per the punch list you requested. It fully releases Re-Bath and its affiliates from all responsibility.

Option two covers the damage done to our home by the water leak created by Re-Bath. It also requires Re-Bath to honor the warranty last issued by Heidi Seyler on 2/22/2008. It does not release Re-Bath of California from responsibility. (Email referenced is provided below.)

Copies of the work orders/invoices from Pat’s Pronto Plumbing are still required for either option.

Crank Calls? Give Us a Break! Childish Behavior, the Sign of a Real Loser…

Another Side bar of sorts.

This is point that should be brought up and it goes to the attitude and mentality of this outfit. It is about the crank calls we would receive from phone numbers (thank goodness for caller I.D.) attributed to Re-Bath of CA.
These calls coincided with the delivery of court documents. We would receive our copies of actions we’d taken against Re-Bath, so we knew Randy Summy and Re-Bath CA were receiving a set at the same time we were, or maybe at most the next day. And sure enough, the crank calls would start.
Sheer coincidence? Very difficult to believe.

Talk about childish, let alone unprofessional behavior, but then again, we are repeating ourselves again… This is one very dishonest and unprofessional outfit that makes a personal issue out of bad service. Lies, name calling and crank calls. What is this first grade!?

We must again recommend you avoid Re-Bath like the plague.

Compromise? Re-Bath Will Not Compromise You Give an Inch, They Demand a Mile

This was our response to that self serving attempt by Re-Bath to rewrite the facts for Re-Bath’s benefit.

This email was sent on June 11th, 2008:
“Norm,
I really thought you would offer something fairer to us considering the situation, and especially since you started off a few weeks ago by stating “We would like to resolve these issues quickly to avoid any further delay & make sure you are fully satisfied.”

But as I said yesterday, I would accept the $5050.00 and still will, although it does not fully rectify the situation nor fully compensate us for damages done.
Send your document for me to sign.

I do hope you will try and be able to get the work orders from Pronto Plumbing to us.

Please see what you can do to expedite this.

You see that is what is called a compromise. Not a fair one for us, we are getting screwed, but we are trying to resolve this mess.
The document they sent was from another prior complaint situation apparently as it was titled as a settlement between them and Cold Stone Creamery. Sounds like they screwed Cold Stone Creamery too.
Just an observation…
Why else would such a document exist? We’re willing to listen to logical excuses.
Or did they plagiarize it? Again, with such low ethical standards as we’ve seen from Re-Bath, who knows?

And what about that invoice from Pat’s Pronto Plumbing? Why is that so difficult to get them to provide?
Could it be they want to erase the paper trail that ties them to the work? We think so; we have no reason to believe otherwise…
And it’s not like their track record smacks of honesty… Oh no, much to the contrary…
